AFAIK, you don't need a license, but you may want some maintenance contract. For SLES it's the "HA extension" you want to subscribe (unless you use "SLES for SAP Applications" which includes the HA extension). If you build all your software yourself, you don't need such maintenance, but that road could be adventurous, I'd say...
